Litigation and Dispute Resolution : Collaborative Family Law

In the 1990s, a widespread desire to handle some family law disputes outside of the potentially very confrontational courtroom setting led to the development in our profession of Collaborative Family Law (CFL). When both parties in a family law dispute want to stay out of court, they can often successfully negotiate a settlement with the guidance of lawyers who, beyond their law degrees and admission to the provincial bar, have obtained further certification in a collaborative approach to negotiating divorce terms, the division of assets, custody, visitation and maintenance agreements. Both parties enter the process committed to respectful communication and both lawyers agree that, in the event of not being able to reach a settlement through the collaboration, they will not take part in any litigation between the couple. These commitments ensure that everyone’s efforts are focused on the speedy and fair resolution of differences, which is surely in the best interest of both parties.
